This document details the terms and conditions for Tutorsaurus. By using the website or our tutoring services, you are confirming that you agree to these terms and conditions so please take the time to read them.

If you use this website to hire a tutor, references in these terms and conditions to Tutee are applicable. If you use this website to work as a tutor, references in these terms and conditions to Tutor apply to you. All other provisions in these terms and conditions apply to all users.

Please, note that these terms and conditions may be liable to change from time to time.

Definitions

1. The following expressions are given the following meanings:

(a) "Contract" means the agreement between the Tutor and the Tutee.

(b) "Tutorsaurus website" means the website operated by Tutorsaurus.

(c) "Tutee" means a person that uses the Tutorsaurus website with the intension of entering into a contractual relationship with a Tutor for the provision of tuition services.

(d) "Tutor" means a person that has appropriate qualifications and experience to provide tuition services in the areas advertised by the Tutor on the Tutorsaurus website, with the intention of entering into a Contract to provide tuition.

2. All business undertaken by Tutorsaurus, a Tutor and/or a Tutee or his parent/guardian is transacted subject to these Terms. In the event of any conflict between these Terms and any other terms and conditions, these Terms shall prevail.

3. Tutorsaurus will take precautions it considers appropriate to keep the details of a Tutor and Tutee secure but will not be liable for unauthorised access to the information provided by a Tutor and Tutee on the Tutorsaurus Website.

For The Tutor

4. A Tutor warrants that he:

(a) is of at least eighteen years of age;

(b) has the necessary qualifications and/or experience to provide tuition in the subjects specified by the Tutor on the Tutorsaurus website.

5. Tutors who contact Tutees who are under the age of 18 must ensure that the Tutee has consent from a parent or a guardian to provide tuition services to the Tutee.

6. A tutor takes full responsibility for all information that he provides on the Tutorsaurus Website and must indemnify Tutorsaurus in relation to any liability incurred by Tutorsaurus as a result of such information.

7. A Tutor shall indemnify Tutorsaurus for all claims and liabilities arising out of any use by the Tutor of the Tutorsaurus Website, including costs and expenses incurred.

8. A Tutor is not an employee of Tutorsaurus and accepts full responsibility for all Income Tax, National Insurance and other liabilities arising from use of the Tutorsaurus Website.

9. All information provided by a Tutor on the Tutorsaurus Website must be accurate and kept up-to-date.

10. Use of the Tutorsaurus Website is entirely at a Tutor’s own risk.

11. A Tutor must not be in any way abusive about a Tutee or his nominee on the Tutorsaurus Website or any other place.

12. Tutorsaurus is not liable to the Tutor for any fees that have not been paid by the Tutee and will not get involved in any disputes about fees between a Tutor and a Tutee.

For The Tutee

13. A Tutee agrees not to use Tutorsaurus to advertise, promote or search for tuition services for their own company, nor may an agency acting for a company register to promote their services or opportunities.

14. A Tutee must not publish any abusive comments about a Tutor or a Tutee on the Tutorsaurus Website.

15. A Tutee must not publish any abusive comments about a Tutor or a Tutee on any other websites.

16. A Tutee must have consent from a parent or a guardian to register and that parent or guardian must enter into any agreement with a Tutor to provide tuition services.

17. A Tutee, or where relevant their parent/guardian, accepts that his Contract for tuition services is with the Tutor.

Payment Plans

18. We offer two options for payment:

• A prepayment plan
• A monthly billing plan

19. With the monthly payment plan, you receive a monthly invoice for the previous month’s tuition. The invoice will arrive in the first week of the following month and should be paid within 14 days of the invoice date. The invoice covers payment for the tutor and any fees due to Tutorsaurus.

20. The prepayment plan offers a reduced rate for tuition for an agreed number of sessions. It is paid in advance and covers payment for the tutor and any fees due to Tutorsaurus. Once the course has commenced, there are no refunds for the cancellation of the course by the client, prior to the conclusion of the course. However, as mentioned, the course is flexible in terms of holidays, illness and lesson cancellations with 24 hours notice.

21. At the end of your booked course, you can either end the tuition, book another prepayment plan or a monthly payment plan. The choice is completely up to you. If you don’t let us know your preference, you’ll automatically be moved onto the monthly billing plan.

22. Residential tutors and full time tutors are charged by the day. If the tutor is expected to stay with the family, the board is included in the fee.

Our Fees

23. Clients are required to pay a registration fee prior to registering with Tutorsaurus. This is an administration fee that covers background checks and selection of the appropriate tutor for each client. This fee includes a free first lesson with the tutor.

24. The registration fee is refundable within 7 days of registration or if Tutorsaurus fail to find a tutor in the subject and area the client requested.

25. Fees are agreed verbally with the client and tutor prior to the first lesson. There may be a reasonable charge for travel required by the tutor. This should be discussed prior to your commencement of a contract.

26. If the client has chosen the prepayment plan, no discount is received for the tutor’s travel. Again, this should be discussed before the commencement of a contract. The travel charge is added as a separate payment. 

Client Satisfaction Policy

27. When a client has prebooked a course of tuition, and are unhappy with the level of service received, they can request a new tutor at no extra cost. If a replacement tutor can’t be found, the client will receive a full refund for each of the lessons that haven’t taken place.

Cancelling A Lesson

28. If your child is ill or has to cancel, please contact your tutor directly. If you cancel more than 24 hours before the lesson, you will not be charged. As it takes time to adjust schedules, cancellations within 24 hours of the lesson will be charged at the rate for one hour.

29. If the tutor has to cancel a lesson, they’ll contact you immediately to rearrange a suitable alternative.

Ending The Tuition

30. You are free to end the tuition whenever suits you. All you need to do is give a week’s notice in writing to both Tutorsaurus and your tutor. This gives your tutor the opportunity to conclude their work with the tutor and plan their future commitments. 

31. If a tutor has to stop tuition before the end of the course, Tutorsaurus will endeavour to find a suitable replacement in a timely manner. 

Intellectual Property

32. The code, brand and intellectual property of the Tutorsaurus Website cannot be reused without Tutorsaurus’s consent. All copyright, trade marks, and other intellectual property rights in and relating to the Tutorsaurus Website (including the material which is contributed by Members) are owned by Tutorsaurus. It is prohibited to copy, distribute, show in public or create any derivative work from the Tutorsaurus Website, or any of the material which is found on the Tutorsaurus Website without the consent of Tutorsaurus. Please see our Copyright Notice, which forms part of these Terms and Conditions.

33. By submitting any material to the content to the Tutorsaurus Website, you:

(a) are representing that you are fully entitled to do so;

(b) grant Tutorsaurus a non-exclusive, royalty-free, non-terminable licence to copy, modify, distribute, show in public and create derivative works from that material in any form and any place; and

(c) authorise Tutorsaurus to adapt the relevant material and you waive the right to be identified as the author of the material in question.

Extra Notes

34. Tutorsaurus may, at their sole discretion, vary the features of the Tutorsaurus Website and the Terms of use at anytime.

35. Tutorsaurus may monitor postings to the Tutorsaurus Website and communications through the Tutorsaurus Website and have the right to delete and/or block such postings or communications at their sole discretion.

36. Tutorsaurus reserves the right to withdraw or modify aspects of the Tutorsaurus Website, or the entirety of it.

37. Tutorsaurus may use data for statistical analysis and may provide this to interested third parties.

38. Tutorsaurus give no guarantee that the Tutorsaurus Website is free of viruses worms or any other form of harmful components.

39. The distance data supplied on the Tutorsaurus website is calculated using the latitude and longitude of the postcode. On occasions we only use part of the Postcode, so Tutorsaurus can not guarantee that the data supplied on distances between postcodes is accurate.

40. Tutorsaurus's Privacy Policy forms part of these Terms and Conditions, and by agreeing to these Terms and Conditions, you also give your consent to the way we may handle your personal data as detailed in that policy. Given the global nature of the World Wide Web, any posting on the Tutorsaurus Website (including any which contain personal information) is, of course, accessible to internet users around the world.

IMPORTANT: All users of this website must ensure that the e-mail address and other contact details are always kept updated. We may need to contact you for important messages. If you change your contact details you must inform us of the new details.
